$5 Million Dollars Awarded to Medical Malpractice Victim

10 years ago Sharon Virginelli had a baby girl.  That baby girl was the first child in what Ms. Virginelli hoped would be a large family.  However, Ms. Virginelli’s dreams of having many children would never come true.  When she came out of anesthesia she learned that her obstetrician had delivered her baby but had also given her a hysterectomy.

Ms. Virginelli’s obstetrician claimed that she performed the hysterectomy to stop life threatening excessive bleeding.  However, Ms. Virginelli’s attorney successfully argued that there were other ways to stop the bleeding that would have been as effective and that the hysterectomy was unnecessary. Experts testified that Ms. Viginelli’s bleeding was slowing down when the hysterectomy was performed and that other less intrusive surgical procedures would have been adequate.

The case was tried before a Cook County jury last week and the jury found the obstetrician to have committed medical malpractice.  Ms. Virginelli was awarded $5 million dollars in her medical malpractice case.  Although the verdict came 10 years after the injury, the jury took just four hours to come to its decision after a week long trial.
