On August 23, 2009 a Chicago man died when he stepped off the curb in order to cross the street at the corners of Chicago and Ashland Avenues in the Wicker Park section of Chicago. The man, Stephen Richardson, was hit by a big truck at about 10 p.m. Mr. Richardson was pronounced dead at Cook Country Stroger Hospital shortly after the accident.
The Chicago Police Department’s Major Accident Investigation Unit has not yet reported any charges against the truck driver. However, it is possible that the truck driver will still face significant legal problems. Whether or not the Chicago Police Department has finished its investigation, the family may bring a wrongful death lawsuit against the truck driver.
Families that are considering bringing civil lawsuits because their loved ones have been the victims of pedestrian accidents should consult with a Chicago pedestrian accident attorney who can advise them as to their legal rights and the possible outcomes of litigation or settlement discussions.
Pedestrians are at a unique and distinct disadvantage on Chicago roadways. The potential for harm to a pedestrian is different than the potential for harm to the occupant of a car or truck in an accident. Therefore, it is important to be aware of the danger and to seek the advice of an attorney if a pedestrian tragedy should happen in your family.
