The Madison St. Clair Record recently reported that a lawsuit has been filed against a male trucker and the trucking company he works for, C. Grantham Co. According to the article, the lawsuit states that the truck accident was caused by a wheel that had detached from the back of the truck’s tractor-trailer, and then crashed into the front of the plaintiffs’ vehicle.
In attributing the serious injury accident to the truck driver’s inexperience, the plaintiffs also claim that both the trucker and the trucking company failed to properly inspect the wheels, nuts, bolts and other wheel fasteners of the semi-trailer prior to the accident. The lawsuit asserts that the truck driver operated the large vehicle at an unsafe speed given the state of the wheels. Moreover, the plaintiffs declare that the trucking company did not fully or properly train or guide the trucker in regards to federal, state and county regulations and other laws influencing the upkeep, operation, and/or examination of semi-trucks and semi-trailers.
While every truck injury accident claim may vary to a great degree, there is no doubt that collisions with commercial vehicles often result in serious to catastrophic injuries sustained by occupants of smaller vehicles. The Federal Motor Carrier Safety Administration provides explanations for the inspection, repair, and maintenance of commercial vehicles. Under Part 396.3, it is required that “parts and accessories shall be in safe and proper operating condition at all times…and any additional parts and accessories which may affect safety of operation, including but not limited to, frame and frame assemblies, suspension systems, axles and attaching parts, wheels and rims, and steering systems.”
