These actions are brought by parents of a disabled newborn against an allegedly negligent physician or hospital who failed to advise them of the increased risks of giving birth to a disabled child or of the availability and appropriateness of undergoing prenatal diagnostic testing to determine the presence of a defective fetus, depriving the parents of the ability to choose either not to conceive the child or to abort the fetus during pregnancy. If successful with their claim, the parents may recover for pecuniary expenses that they will incur in providing for the child’s care and treatment.
